Texas Federal Judge Orders Biden Admin. To Block DACA Program To New Applicants

Former President Barack Obama broke federal law when he unilaterally established the Deferred Action for Childhood Arrivals (DACA) program, which has granted quasi-amnesty to hundreds of thousands of illegal immigrants since 2012.

Judge Andrew Hanen ordered President Joe Biden’s administration to essentially shut down the DACA program on Friday, prohibiting the federal government from accepting new applications, even illegal immigrants who have never been enrolled in the program.

“DHS violated the [Administrative Procedure Act] with the creation DACA and its continued operation … the DACA Memorandum and the DACA program that it created are hereby vacated and remanded to DHS for further consideration, as requested,” Hanen writes.

“DHS … is hereby enjoined from approving any new DACA applications and granting the attendant status,” Hanen continues.

The ruling disrupts the Biden administration’s intention to expand the DACA program by adding new applicants to the registers. Biden and elected Democrats in Washington, D.C. have been trying for months to get an amnesty for DACA illegal immigrants passed, most recently by sneaking it into a Senate Democrat budget that only required a simple majority vote.

More than 2,100 DACA illegal immigrants have been thrown out of the program as of 2017, after committing a criminal or being proven to have committed a felony in the past.

Texas v. United States, No. 1:18-cv-00068, is a case filed in the United States District Court for the Southern District of Texas.
